These terms and conditions apply to all care and services provided by DKliniek. They set out our mutual rights and obligations, including appointments, cancellation, rates, liability and complaints.

Article 1 - Definitions
In these terms and conditions the following definitions apply:
DKliniek: the vaccination clinic at Osdorperweg 505, 1067 SR Amsterdam, registered with the Dutch Chamber of Commerce under number 98090372.
Client: the natural person receiving care from DKliniek, or their legal representative.
Practitioner: the BIG-registered healthcare professional working at DKliniek who provides the care.
Services: all care and services offered by DKliniek, including travel advice, vaccinations, medical assessments, prescription requests and on-site care.
Treatment agreement: the medical treatment agreement within the meaning of Article 7:446 of the Dutch Civil Code between DKliniek and the client.
Website: dkliniek.nl and all related online environments of DKliniek.
Article 2 - Applicability
These terms apply to every offer, quotation, appointment and treatment agreement between DKliniek and the client, as well as to the use of the website.
Deviations from these terms are valid only if expressly agreed in writing.
The applicability of any terms of the client or a third party is expressly rejected.
If a provision is void or voidable, the remaining provisions remain in full force and the parties will agree on a replacement provision that reflects the original intent as closely as possible.
Article 3 - Services and quality
DKliniek provides travel medicine care in accordance with the guidelines of the Dutch National Coordination Centre for Travellers' Advice (LCR) and the professional standard.
Services include travel advice and travel vaccinations, vaccination programmes for Hajj and Umrah, corporate and group vaccinations, on-site care and online prescription requests.
DKliniek works exclusively with BIG-registered healthcare professionals and is affiliated with the LCR.
DKliniek undertakes a best-efforts obligation and never an obligation of result. No particular outcome, immune response, medical eligibility, prescription or entry into a country is guaranteed.
The practitioner may refuse or postpone care if this is medically irresponsible, if the client provides insufficient or incorrect information, or if the request falls outside the services offered.
On-site or home care is available in the Amsterdam region against a surcharge as stated on the website.
Article 4 - Formation of the agreement
The treatment agreement is formed when DKliniek confirms an appointment or online request and the client attends for care.
Information and rates on the website constitute an invitation to make an appointment and not an irrevocable offer.
DKliniek treats by appointment only. For urgent appointments, availability can be checked by telephone or WhatsApp.
For clients under 16, consent from a legal representative is required; the representative must attend or have demonstrably given consent.
Article 5 - Appointments, cancellation and no-show
Cancelling or rescheduling an appointment is free of charge up to 24 hours before the scheduled time, by telephone, WhatsApp or email.
For cancellations within 24 hours of the appointment, or if the client does not attend (no-show), DKliniek charges a no-show fee of € 50 per reserved appointment.
The no-show fee covers reserved treatment time and is not reimbursed by health insurers.
In cases of demonstrable force majeure on the client's side, DKliniek may waive the no-show fee in whole or in part. No entitlement to such a waiver exists.
If the client arrives more than 10 minutes late, the appointment may be shortened or rescheduled; the no-show fee may apply.
DKliniek may reschedule an appointment where necessary for responsible care and will inform the client as soon as possible, offering an alternative time.
In case of repeatedly missed appointments, DKliniek may refuse further services.
Article 6 - Rates and payment
Current rates are published on the website and available on request. All rates include VAT where VAT is due; medical care is in principle VAT-exempt.
Payment is due immediately after treatment unless otherwise agreed in writing. Online services are paid in advance.
Payment is possible by debit card, cash, Tikkie or through the online payment environment.
Reimbursement by a health insurer depends on the policy. The client is responsible for verifying coverage; the absence of reimbursement does not release the client from the payment obligation towards DKliniek.
In the event of late payment the client is in default by operation of law and DKliniek may charge statutory interest and extrajudicial collection costs in accordance with Dutch law.
DKliniek may amend its rates. For appointments already confirmed, the rate communicated at the time of booking applies.
Article 7 - Online malaria prescription request and refunds
The fee for an online malaria prescription request is an assessment fee for the medical review by a BIG-registered doctor. It is not the price of a prescription; a prescription is never guaranteed.
The assessment is based on the information provided by the client, who warrants its accuracy and completeness.
If the doctor concludes after assessment that malaria prophylaxis cannot be prescribed for medical reasons, 50% of the assessment fee is refunded.
If no assessment has taken place (for example a duplicate payment, cancellation before the assessment, a technical error, or a request outside our services), 100% is refunded.
If we refer the client to a consultation at the clinic, the client may choose between a 50% refund or offsetting the full amount against the consultation fee.
If a prescription is issued, no refund is possible, even if the client decides not to use it.
Refunds are processed within 5 working days via the same payment method used for the original payment.
The prescription is made available to the client through the patient system MijnDiad. The client submits the prescription to a pharmacy of their choice.
Remote assessment and prescribing are permitted. If the information provided is incomplete or conflicting, the clinician may decide on a consultation instead of a remote prescription.
The medical record is retained in the patient system MijnDiad in accordance with the statutory retention period (Dutch Wgbo, 20 years).
Because the service is performed immediately with the client's express consent, the statutory right of withdrawal lapses once the assessment has started.
Article 7a - Fit to fly assessment and certificate
The fee for a fit to fly assessment is an assessment fee. A certificate is only issued when the practitioner considers flying medically responsible; issuance is never guaranteed.
The standard fee is € 75 with an assessment within 24 to 48 hours of receiving the complete digital intake.
If the client chooses the urgent option, the fee is € 100 and the assessment follows within 6 hours of receiving the complete digital intake.
These timeframes start once all requested information and any documents from a treating specialist have been received.
If the practitioner does not issue a certificate after assessment, 50% of the fee is refunded.
If no assessment has taken place, 100% is refunded.
Payment is made at the clinic unless otherwise agreed in writing.
The certificate is issued in Dutch or English. The client checks the airline's requirements, including the maximum age of the certificate and the use of the airline's own form or MEDIF.
DKliniek is not liable for an airline's decision to refuse carriage.
Article 8 - Client obligations and duty to inform
The client is obliged to:
provide complete and accurate information about medical history, allergies, medication use, pregnancy or breastfeeding, previous reactions to vaccinations and the travel itinerary;
report without delay any change in health status relevant to the care;
bring valid identification and, if available, the international certificate of vaccination;
follow the instructions and advice of the practitioner;
report side effects or complications in good time to DKliniek or, in an emergency, to the out-of-hours GP service or 112.
DKliniek is not liable for consequences of incorrect, incomplete or late information provided by the client.
Article 9 - Medical disclaimer
Information on the website, in advice, calculators or automated tools is general in nature and never replaces an individual medical judgement.
Automated decision support is used only as an aid; a BIG-registered healthcare professional always takes the final decision.
Travel advice and country information may change. The client is responsible for checking current entry and vaccination requirements with the relevant authorities.
Vaccinations do not guarantee full protection; additional measures such as mosquito protection remain necessary.
Article 10 - Liability
DKliniek provides care to the best of its knowledge and ability and in accordance with the professional standard.
DKliniek's liability is limited to the amount paid out in the relevant case by its professional or business liability insurance, increased by the applicable deductible.
If no payment is made under that insurance, liability is limited to the amount charged for the service concerned.
DKliniek is not liable for known and normal side effects of vaccinations or medicines, which are discussed with the client in advance.
DKliniek is not liable for indirect damage, including consequential loss, missed trips, cancelled flights, refused entry to a country or loss of income.
These limitations do not apply in the event of intent or deliberate recklessness on the part of DKliniek.
Any claim lapses if it is not reported to DKliniek in writing within twelve months of the damage becoming known.
Article 11 - Force majeure
DKliniek is not obliged to perform if prevented by circumstances beyond its reasonable control, including:
natural disasters, pandemics or epidemics;
government measures or legislative changes;
strikes or labour disputes;
supply or production problems affecting vaccines and medical materials;
failure of utilities, IT or communication systems.
Obligations are suspended for the duration of the force majeure. If it lasts longer than thirty days, either party may terminate the agreement without liability; amounts already paid for services not delivered are refunded.
Article 12 - Privacy and medical records
DKliniek processes personal data in accordance with the GDPR, the WGBO and Dutch healthcare data legislation.
Medical data is shared with third parties only with the client's express consent or where required by law.
The medical record is retained for the statutory period of twenty years.
The client has the right to access, obtain a copy of, correct, restrict and erase data, to the extent permitted by law.

Article 13 - Complaints and disputes
Complaints about care or services can be submitted to info@dkliniek.nl, preferably within thirty days of the complaint arising.
DKliniek addresses the complaint within fourteen working days and aims to resolve it by mutual agreement.
If no agreement is reached, the client may contact the independent complaints officer free of charge and subsequently the recognised disputes body under the Dutch Wkkgz to which DKliniek is affiliated.
All agreements are governed exclusively by Dutch law. Disputes are submitted to the competent court in the district of Amsterdam, without prejudice to the client's right to choose the court designated by law.
Article 14 - Intellectual property
All intellectual property rights in the website, texts, images, logos, calculators and other content belong to DKliniek or its licensors. Reproduction, publication or reuse is not permitted without prior written consent.
Article 15 - Amendments to these terms
DKliniek may amend these terms. Amended terms are published on the website and apply to agreements concluded after publication. For existing appointments, the version in force at the time of booking applies.
